To amend title 18, United States Code, to clarify that private, one-on-
one communications constitute a notice or advertisement for purposes of 
the Federal crime of making a notice or advertisement to seek or offer 
                           child pornography.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Protection of Child Victims from 
Online Predators Act''.

SEC. 2. AMENDMENT TO TITLE 18, UNITED STATES CODE.

    Section 2251(d) of title 18, United States Code, is amended by 
adding at the end the following:
    ``(3) For purposes of this subsection, a notice or advertisement 
can occur in a private, one-on-one communication.''.
