                                 A BILL


 
   To amend title 28, United States Code, to clarify the limitations 
period during which an action may be commenced for judicial review of a 
                              final rule.

    Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``Timely Initiation to Modify 
Executive Rulemaking Act'' or the ``TIMER Act''.

SEC. 2. STATUTE OF LIMITATIONS.

    Section 2401 of title 28, United States Code, is amended--
            (1) in subsection (a), by inserting after ``chapter 71 of 
        title 41'' the following: ``and subject to subsection (b)'';
            (2) by redesignating subsection (b) as subsection (c); and
            (3) by inserting after subsection (a) the following:
    ``(b) A civil action commenced against the United States under 
chapter 7 of title 5, United States Code, for judicial review of a 
final rule shall be barred unless the complaint is filed within six 
years after the date on which the final rule is issued.''.
