bill; which was referred to the Committee on Ways and Means, and in
addition to the Committee on Energy and Commerce, for a period to be
subsequently determined by the Speaker, in each case for consideration
of such provisions as fall within the jurisdiction of the committee
concerned

A BILL
To amend title XVIII of the Social Security Act to provide coverage of
certain technologies and medical devices under the Medicare program.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Supporting Innovation for Seniors
Act''.
SEC. 2. COVERAGE OF CERTAIN TECHNOLOGIES AND MEDICAL DEVICES.
Section 1852(a)(3) of the Social Security Act (42 U.S.C. 1395w-
22(a)(3) is amended--
(1) in subparagraph (A), by striking ``subparagraph (D)''
and inserting ``subparagraphs (D) and (E)''; and
(2) by adding at the end the following new subparagraph:
``(E) Coverage of certain technologies and medical
devices.--
``(i) In general.--For plan year 2025 and
subsequent plan years, in addition to any
supplemental health care benefits otherwise
provided under this paragraph, an MA plan,
including a specialized MA plan for special
needs individuals (as defined in section
1859(b)(6)), may provide the supplemental
benefits described in clause (ii).
``(ii) Supplemental benefits described.--
``(I) In general.--The supplemental
benefits described in this clause are
as follows:
``(aa) A medical device or
technology that has a national
coverage determination or local
coverage determination under
this title for an indication
that is different than the
indication for such coverage
determination.
``(bb) A technology that
does not fit into another
benefit category under this
title.
``(II) Authority to waive
uniformity requirements.--The Secretary
may, only with respect to supplemental
benefits provided under this
subparagraph, waive the uniformity
requirements under this part, as
determined appropriate by the
Secretary.''.
