S.B. No. 29 proposes to amend the Health and Safety Code by adding Section 1001.090, which authorizes the commissioner of state health services to issue a statewide order allowing licensed pharmacists to dispense ivermectin without a prescription from a healthcare practitioner. The bill outlines that the order must include standardized procedures for pharmacists to follow and mandates that they provide patients with instructions on the proper use of ivermectin. Additionally, it stipulates that pharmacists acting reasonably while dispensing ivermectin under this order will not face criminal or civil liability or professional disciplinary action.

Furthermore, the bill requires pharmacists to submit an annual report detailing the number of doses of ivermectin dispensed in accordance with the statewide order. It also allows the executive commissioner and the Texas State Board of Pharmacy to adopt necessary rules for implementation. Importantly, the issuance of the statewide order by the commissioner cannot be used as a basis for criminal or civil liability against them or for disciplinary action by any licensing entity. The act is set to take effect 91 days after the end of the legislative session.
