This bill amends the Family Code and Government Code to allow for the use of digitized signatures in the execution of waivers of citation in marriage dissolution suits. Specifically, it removes the prohibition against signing the waiver with a digitized signature, thereby enabling parties to utilize electronic methods for this legal process. Additionally, the bill clarifies that in proceedings under Title 1 or 5 of the Family Code, electronic signatures can fulfill the requirements for notarization, acknowledgment, verification, or oaths, as long as they are properly associated with the required signatures.
The changes made by this Act apply to any waiver of citation executed in ongoing marriage dissolution cases as of the effective date or in cases filed thereafter. The Act is set to take effect 91 days after the conclusion of the legislative session.
