H.B. No. 5350 introduces a new chapter to the Government Code, specifically Chapter 2010, which establishes requirements for public notice and comment regarding certain policies adopted by state agencies. The bill mandates that before a state agency can implement or adopt a policy affecting procedures or actions related to private individuals, it must provide notice of its intention in a manner similar to that used for rule adoption under Section 2001.023. Additionally, the agency must offer a reasonable opportunity for public comment, akin to the process outlined in Section 2001.029(a). The agency is also required to fully consider all comments received regarding the proposed policy.

The provisions of this bill do not apply to rules that are already subject to the requirements of Subchapter B, Chapter 2001. The changes enacted by this bill will only affect policies implemented or adopted on or after its effective date, which is set for September 1, 2025.
