H.B. No. 5350 introduces a new chapter, Chapter 2010, to the Government Code, which mandates that state agencies provide public notice and an opportunity for public comment before adopting or implementing certain policies that affect procedures or actions related to private individuals. Specifically, the bill requires agencies to notify the public of their intention to adopt a policy in the same manner as they would for rule adoption under Section 2001.023 and to allow interested parties a reasonable opportunity to comment, similar to the process outlined in Section 2001.029(a). Additionally, agencies are required to fully consider all comments received regarding the proposed policy.

The provisions of this bill do not apply to rules that are already subject to the requirements of Subchapter B, Chapter 2001. The changes enacted by this bill will only affect policies implemented or adopted on or after its effective date, which is set for September 1, 2025.
