The bill, S.B. No. 2831, introduces new provisions regarding the compensation and professional representation of students participating in University Interscholastic League (UIL) activities and intercollegiate athletic programs at certain higher education institutions. It adds Section 33.098 to the Education Code, which stipulates that eligible students—defined as those 18 years or older who meet specific academic requirements—are allowed to earn compensation for the use of their name, image, or likeness outside of official league activities. Additionally, these students can obtain professional representation for legal matters related to their name, image, or likeness. The UIL and participating schools are prohibited from enforcing policies that restrict these rights.
Furthermore, the bill amends Section 51.9246(j) of the Education Code to clarify that no arrangements regarding a student athlete's name, image, or likeness can be made unless the athlete is 18 years of age or older. It also prohibits the use of future compensation arrangements as inducements for recruiting prospective student athletes. The changes in law will apply only to contracts entered into, modified, or renewed after the bill's effective date, which will be immediate if it receives a two-thirds vote from both houses, or otherwise will take effect on September 1, 2025.
