S.B. No. 2703 amends Section 82.006 of the Property Code to clarify the authority of municipalities and counties in regulating condominiums. The bill stipulates that local ordinances, regulations, and building codes cannot prohibit the condominium form of ownership or impose requirements on condominiums that are not imposed on similar developments under different ownership forms. Additionally, it specifies that a condominium declaration is not considered a subdivision of land for the purposes of certain chapters in the Local Government Code, and municipalities or counties cannot require the preparation or submission of a subdivision plat when creating or altering a condominium.

The changes introduced by this bill will only apply to condominium declarations filed for recording on or after the effective date of September 1, 2025. Declarations filed before this date will continue to be governed by the existing law. This legislation aims to streamline the regulatory process for condominiums and ensure that they are treated equitably compared to other forms of property ownership.
