The bill amends the Texas Utilities Code to require that lease agreements for wind and solar power facilities include specific provisions related to the recycling and disposal of facility components. It introduces a definition of "Recycle" as the processing of an item to recover a usable product and expands the definitions of "wind power facility" and "solar power facility" to include various components and support equipment. The bill mandates that agreements must specify the grantee's responsibility for collecting, reusing, or recycling components that can be reused or recycled, as well as the proper disposal of components that cannot be recycled, in compliance with applicable laws.

Additionally, the bill stipulates that financial assurance must be provided by the grantee to cover the costs associated with the removal, recycling, or disposal of facility components and the restoration of the property. This financial assurance must be based on estimates from an independent, licensed professional engineer and must be updated regularly. The bill applies only to agreements entered into on or after its effective date of September 1, 2025, while agreements made prior to this date will continue to be governed by the existing law.
