S.B. No. 2570 introduces a new legal defense for peace officers facing prosecution for certain offenses involving the use of less-lethal projectiles. The bill adds Section 8.09 to Chapter 8 of the Penal Code, defining a "less-lethal projectile" as one designed to incapacitate a target while minimizing the risk of serious injury or death. The defense can be invoked if the injury or death resulted from the use of such a projectile, the officer believed the use was reasonable for their duties, did not intentionally or recklessly cause the injury or death, and used the projectile in substantial compliance with their training, agency policies, and manufacturer instructions.

The provisions of this bill apply only to offenses committed on or after its effective date of September 1, 2025. Offenses occurring before this date will be governed by the law in effect at that time, ensuring that the previous legal standards remain applicable for those cases.
