The bill amends Section 503.001 of the Business & Commerce Code to clarify the definitions and regulations surrounding biometric identifiers in the context of artificial intelligence. It introduces a new definition of "artificial intelligence," which encompasses machine learning technologies that enable computer systems to perform tasks typically associated with human intelligence, such as computer vision and natural language processing. Additionally, the definition of "biometric identifier" is modified to specify that it includes various forms of biometric data, such as retina scans and fingerprints, while removing the previous phrasing.
Furthermore, the bill establishes that the provisions of this section do not apply to artificial intelligence activities unless they are conducted for the purpose of uniquely identifying an individual. If a biometric identifier is collected for artificial intelligence but later used for a different commercial purpose, the entity in possession of that data must comply with the regulations regarding the possession and destruction of biometric identifiers, along with the associated penalties. The bill is set to take effect on September 1, 2025.
