The bill amends Section 503.001 of the Business & Commerce Code to clarify the definitions and regulations surrounding biometric identifiers in relation to artificial intelligence. It introduces a new definition of "artificial intelligence," which encompasses machine learning technologies that enable computers to perform tasks typically associated with human intelligence, such as computer vision and natural language processing. Additionally, the definition of "biometric identifier" is refined to include specific types of biometric data, such as retina scans and fingerprints, while removing the previous phrasing.
Furthermore, the bill establishes that the provisions of this section do not apply to artificial intelligence activities unless they are conducted for the purpose of uniquely identifying an individual. If biometric identifiers collected for artificial intelligence are used for other commercial purposes, the entity in possession of that data must comply with the existing regulations regarding the handling and destruction of biometric identifiers, along with the associated penalties. The bill is set to take effect on September 1, 2025.
