Specifically, the bill stipulates that if a tenant fails to satisfy a claim within 14 days of receiving notice, the lessor must provide notice advertising the sale in a commercially reasonable manner. The bill also clarifies the timeline for when a lessor can sell the property based on the method of notice given, including a new provision that allows for sales to occur 10 days after notice is given in a commercially reasonable manner.

Additionally, the bill modifies the method and content of the notice required for advertising the sale. It allows lessors to publish notices in a newspaper or on a publicly accessible Internet website that regularly advertises auctions of personal property. If no newspaper exists in the county, lessors can post notices at the storage facility and other conspicuous locations. Furthermore, the bill establishes that notice is considered commercially reasonable if at least three independent bidders register for, view, or attend the sale. The changes will apply only to rental agreements entered into, extended, or renewed after the bill's effective date of September 1, 2025.
