The bill amends the Texas Property Code to update the requirements for notice advertising the sale of property to enforce a self-service storage facility lien. Key changes include the addition of provisions that allow lessors to give notice advertising the sale in a commercially reasonable manner, in addition to the traditional methods of publication or posting. Specifically, the bill stipulates that if a tenant fails to satisfy the claim within 14 days, the lessor must provide notice advertising the sale, which can be done through publication, posting, or other reasonable means. The timeline for when a lessor can sell the property is also clarified, specifying that sales can occur after certain days depending on the method of notice given.

Additionally, the bill modifies the method and content of the notice required for advertising the sale. It allows lessors to publish the notice in a newspaper or on a publicly accessible Internet website that regularly advertises auctions of personal property. If no newspaper is available, the lessor can post the notice at the storage facility and other conspicuous locations. Furthermore, the bill introduces a definition of what constitutes a commercially reasonable manner for giving notice, which includes having at least three independent bidders register for or attend the sale. The changes will apply only to rental agreements entered into, extended, or renewed after the bill's effective date of September 1, 2025.
