House Bill No. 4773 amends the Alcoholic Beverage Code to facilitate the transfer and sale of malt beverages between licensed premises that share the same ownership or management. The bill introduces a new section, 62.085, which allows holders of a brewer's license to transfer malt beverages produced under their license between their licensed brewery premises, including those operating under alternating brewery proprietorships or contract brewing arrangements. The bill stipulates that such transfers must comply with specific conditions, including providing the commission with vehicle descriptions used for transportation and ensuring that these vehicles are clearly marked. Additionally, it clarifies that malt beverages transported under this section are considered produced at the original premises and allows for their sale to consumers and distributors.

The bill also amends existing sections of the Alcoholic Beverage Code, including Section 69.11, which now specifies that the owner of multiple licensed retail premises can exchange or transport malt beverages only if certain conditions are met, while also exempting transfers between licensed brewpubs under the same management. Furthermore, Section 74.08 is revised to allow brewpub license holders to sell transported malt beverages to consumers and qualified persons, and a new Section 74.12 is added to permit brewpubs to transfer brewed beverages between their locations under similar conditions as those for brewers. The act is set to take effect on September 1, 2025.
