The bill, S.B. No. 2386, amends the Water Code to enhance communication between the Texas Commission on Environmental Quality (TCEQ) and state legislators regarding administrative actions. Specifically, it requires the TCEQ to publish notice of penalties in the Texas Register within ten days of a decision and to notify the state representative and senator of the area where the violation occurred, if required. Additionally, the TCEQ must offer each state legislator the opportunity to receive such notifications and provide appropriate notice to those who opt in.

Furthermore, the bill mandates that before the TCEQ approves any administrative orders or proposed agreements related to enforcement actions, it must allow public comment and publish notice of this opportunity in the Texas Register at least thirty days prior to the comment period's closure. Similar to the penalty notifications, the TCEQ is also required to notify the relevant state legislators about the proposed orders or agreements, with the same opt-in notification process for legislators. The provisions of this bill are set to take effect on September 1, 2025.
