The bill, S.B. No. 2386, amends the Water Code to enhance the notification process regarding administrative actions taken by the Texas Commission on Environmental Quality (TCEQ). It introduces new requirements for the commission to publish notice of penalties in the Texas Register within ten days of a decision and mandates that they notify the state representative and senator of the area where the violation occurred, if required. Additionally, the commission must offer each state representative and senator the opportunity to receive such notifications and provide appropriate notice to those who opt in.
Furthermore, the bill stipulates that before the TCEQ approves any administrative orders or proposed agreements related to enforcement actions, it must allow public comment on these proposals and publish notice of the comment period in the Texas Register at least thirty days prior to its closure. Similar to the penalty notification process, the commission is required to notify the relevant state representatives and senators about the proposed orders or agreements, with the same opt-in notification process for legislators. The provisions of this act are set to take effect on September 1, 2025.
