The bill, H.B. No. 4664, mandates that public schools in Texas, including school districts, the Texas School for the Blind and Visually Impaired, the Texas School for the Deaf, and open-enrollment charter schools, provide reasonable accommodations for lactating students at the middle and high school levels. Specifically, the bill requires these institutions to enable lactating students to express breast milk, breast-feed an infant child, and address other needs related to breast-feeding. This new provision is added as Section 38.044 to Subchapter A, Chapter 38 of the Education Code.

The bill is set to take effect at the beginning of the 2025-2026 school year. It will become effective immediately if it receives a two-thirds majority vote from all elected members in both houses; otherwise, it will take effect on September 1, 2025.
