The bill amends Article 17.292(j) of the Code of Criminal Procedure regarding the duration of emergency protection orders. Specifically, it changes the effective period for these orders: those issued under Subsection (a) or (b)(1) will now remain in effect for up to 91 days, instead of the previous 61 days, while orders issued under Subsection (b)(2) will last up to 121 days, an increase from the prior 91 days. The bill also stipulates that the defendant must be served a copy of the order by the magistrate or their designee, and a record of this service must be maintained.

Additionally, the bill clarifies that any modifications to the emergency protection orders can only occur after notice to affected parties and a hearing, ensuring that the modifications do not increase risk to the victim or endanger any protected individuals. The changes will apply only to orders issued on or after the effective date of the Act, which is set for September 1, 2025, while orders issued prior will continue to be governed by the existing law.
