S.B. No. 2169 introduces a new provision to the Texas Education Code that mandates school districts to provide their employees with a minimum of two days of wellness leave per year, in addition to any other leave entitlements. This new leave is specifically designated for wellness purposes and cannot be accumulated or deducted from the employee's existing personal leave. Furthermore, the bill requires school districts to establish policies regarding the use of this wellness leave, including the procedures for processing and documenting such leave. Notably, the bill prohibits school districts from requiring documentation for the days taken under this new wellness leave provision.
The implementation of this act is set to begin with the 2025-2026 school year, and it will take effect immediately if it receives a two-thirds majority vote from both houses of the legislature. If the necessary vote is not achieved, the act will come into effect on September 1, 2025.
