S.B. No. 2169 introduces a new provision to the Texas Education Code that mandates school districts to provide their employees with a minimum of two days of wellness leave per year, in addition to any other leave days already available. This new leave is specifically designated for wellness purposes and cannot be accumulated or deducted from the employee's existing personal leave. Furthermore, school districts are required to establish policies regarding the use of this wellness leave, including the procedures for processing and documenting the leave. Notably, the bill prohibits school districts from requiring documentation for the days taken under this new wellness leave provision.

The bill is set to take effect at the beginning of the 2025-2026 school year, and it will be enacted immediately if it receives a two-thirds majority vote from all elected members in both houses of the legislature. If the necessary vote for immediate effect is not achieved, the bill will still come into force on September 1, 2025.
