S.B. No. 2169 amends the Education Code to establish a new provision for personal leave related to wellness for school district employees. The bill introduces a new subsection (a-1) to Section 22.003, which entitles school district employees to a minimum of two days of paid leave per year specifically for wellness purposes. This leave is in addition to any other leave days provided by the school district or under existing law. Importantly, the wellness leave cannot be accumulated or deducted from the employee's personal leave balance. Furthermore, school districts are required to adopt policies regarding the use of this leave, including the processing and documentation procedures, but they cannot demand documentation from employees for the days taken under this new provision.

The bill is set to take effect at the beginning of the 2025-2026 school year, and it will be enacted immediately if it receives a two-thirds majority vote from all elected members in both houses of the legislature. If the necessary vote for immediate effect is not achieved, the bill will take effect on September 1, 2025.
