S.B. No. 2145 amends the Local Government Code and the Tax Code to allow advisory bodies of public improvement districts and boards of directors of reinvestment zones to hold meetings via telecommunication devices, such as telephone or video conference calls. Specifically, if a member of the advisory body or board is physically present at the meeting, other members can participate remotely and will be considered present for quorum and voting purposes. This provision applies to all meeting topics and requires that two-way audio communication is maintained throughout the meeting.
Additionally, the bill stipulates that if a board meeting is conducted using telecommunication devices, it must adhere to specific notice requirements, including the physical location of the meeting where the chair or vice chair is present. The meeting must also be open and audible to the public at that location. If the audio communication is disrupted, the meeting must be paused until the connection is restored. The bill is set to take effect on September 1, 2025.
