No. 4126 amends the Education Code to facilitate the transfer of public school students who are children of certain public servants, specifically peace officers, servicemembers, and firefighters. The bill reenacts and modifies Section 25.0344, which now defines "parent" to include individuals standing in parental relation to a student and clarifies the definitions of "firefighter" and "peace officer." The bill allows the board of trustees of a school district to transfer a student to another campus or school district upon request from a parent who is a peace officer, servicemember, or firefighter.
Additionally, the bill specifies that the transfer must be to the campus or school district selected by the parent making the request, but it does not require the school district to provide transportation for the student after the transfer. The provisions of this act will take effect for the 2025-2026 school year, and it will prevail over any conflicting legislation from the 89th Legislature, Regular Session, 2025. The act can take effect immediately if it receives a two-thirds vote from both houses; otherwise, it will take effect on September 1, 2025.
