H.B. No. 4112 amends the Health and Safety Code regarding the disposal and storage of high-level radioactive waste in Texas. The bill specifies that the Texas Commission may not issue general construction permits or approve Stormwater Pollution Prevention Plans for facilities licensed for the disposal or storage of high-level radioactive waste by the U.S. Nuclear Regulatory Commission, with the exception of facilities located at nuclear power reactors or nuclear research and test reactors operated by universities. Additionally, it establishes that such facilities may only store high-level radioactive waste at the site where the waste originated.
The bill also clarifies that, aside from the aforementioned exceptions, no person, including compact waste disposal facility license holders, may dispose of or store high-level radioactive waste in Texas. The changes aim to tighten regulations surrounding high-level radioactive waste management and ensure that such waste is only stored at its source. The act is set to take effect on September 1, 2025.
