S.B. No. 2082 amends the Health and Safety Code to regulate the operation of concrete crushing facilities near hospitals. The bill specifically prohibits the operation of such facilities within 440 yards of a hospital, as well as single or multifamily residences and schools, at the time a permit application is filed. The new language includes the definition of a hospital that is subject to these regulations, specifying that it must be licensed, have more than 200 beds, and be located in a municipality with a population of two million or more, not more than four miles from a railroad switching yard with at least 64 tracks. Additionally, the bill allows for exceptions where the commission may not prohibit operations if the facility is temporarily located in the right-of-way of a public works project.

The bill also establishes a temporary prohibition on operating concrete crushing facilities near qualifying hospitals until the Texas Commission on Environmental Quality adopts the necessary rules. This means that even if a permit has been issued, operations cannot commence until the commission confirms that they comply with the new regulations. The act is set to take effect immediately upon receiving a two-thirds vote from both houses or on September 1, 2025, if that vote is not achieved.
