Senate Bill No. 2030 introduces new regulations regarding name, image, and likeness (NIL) agreements for student athletes in Texas. The bill establishes Chapter 2053 in the Occupations Code, defining a "student athlete" as an individual participating in University Interscholastic League activities or intercollegiate athletic programs. It prohibits agreements that advance a student athlete a percentage of future NIL income while charging interest on that advance. Any agreements that violate this prohibition or attempt to circumvent it are deemed void and unenforceable. Additionally, the bill prohibits any waivers of these requirements, declaring such waivers to be violations of the law.
The bill also outlines civil penalties for violations, with fines up to $100,000 for each infraction. The Texas Attorney General is empowered to take legal action to recover these penalties, seek injunctive relief, and recover attorney's fees and court costs. The provisions of Chapter 2053 will apply only to agreements made after the effective date of the Act, which is set for September 1, 2025.
