H.B. No. 3940 amends the Human Resources Code and the Health and Safety Code to enhance the provision of information regarding Medicaid benefits for newborn children. A new section, 32.0631, mandates that the Texas Health and Human Services Commission provide annual written notices to managed care organizations and healthcare providers. This notice will remind them that when a newborn has not been assigned a Medicaid identification number, the provider can use the mother's Medicaid number for reimbursement claims. Additionally, it encourages providers to inform mothers about the use of their Medicaid identification number until the newborn is enrolled in Medicaid.

The bill also updates the requirements for hospitals and healthcare providers to include information about Medicaid benefits in the resource pamphlets given to new parents. Specifically, it adds a requirement to provide information on Medicaid eligibility and the application process for benefits. Furthermore, it mandates that healthcare providers document the distribution of this information in the mother's records. The implementation of these changes is set to begin on January 1, 2026, with the act taking effect on September 1, 2025.
