House Bill No. 3887, introduced by Metcalf, amends the Parks and Wildlife Code by adding a new subsection (a-1) to Section 11.0171. This new provision mandates that if the value of a contract for constructing, altering, or repairing a public building, or for completing any public work exceeds $150,000, the Parks and Wildlife Department, along with the executive director or their designee, must require the contractor to execute both a performance bond and a payment bond before commencing work.

The bill specifies that the new requirements will only apply to contracts for which the Parks and Wildlife Department first advertises or requests bids, proposals, offers, or qualifications on or after the effective date of the Act, which is set for September 1, 2025. Contracts solicited before this date will continue to be governed by the existing law prior to the amendment.
