House Bill No. 3887 amends the Parks and Wildlife Code by adding a new subsection (a-1) to Section 11.0171, which establishes a requirement for performance and payment bonds from contractors working on public buildings or public works for the Parks and Wildlife Department. Specifically, if the value of a contract exceeds $150,000, the department, the executive director, or the executive director's designee must require the contractor to execute both a performance bond and a payment bond before commencing work.

The new provisions will apply only to contracts for which the Parks and Wildlife Department first advertises or requests bids, proposals, offers, or qualifications on or after the effective date of the Act, which is set for September 1, 2025. Contracts solicited before this date will continue to be governed by the existing law prior to the amendment.
