S.B. No. 1921 amends the Local Government Code to clarify the definitions and requirements related to public improvement districts (PIDs) in certain municipalities, particularly concerning hotel-related projects. The bill introduces new definitions, including "extraterritorial jurisdiction" and "hotel," which encompasses properties that begin operating as hotels after the establishment of a PID. It also specifies that districts created after September 1, 2019, can only undertake projects related to advertising, promotion, or business recruitment that are directly associated with hotels.
Additionally, the bill revises the criteria for qualified petitioners who can initiate the establishment of a PID. It requires that petitions be signed by individuals in management positions at hotels and mandates that these petitioners provide written authorization to enter binding agreements on behalf of hotel owners. The bill repeals certain existing provisions and establishes that the new rules apply only to petitions filed on or after the effective date of the Act. If the Act does not receive the necessary votes for immediate effect, it will take effect on September 1, 2025.
