S.B. No. 1921 amends the Local Government Code to clarify the definitions and requirements related to public improvement districts (PIDs) in certain municipalities, particularly concerning hotel-related projects. The bill introduces new definitions, including "extraterritorial jurisdiction" and "hotel," which encompasses properties that begin operating as hotels after the establishment of a PID. It also specifies that districts created after September 1, 2019, may only undertake projects related to advertising, promotion, or business recruitment directly associated with hotels.
Additionally, the bill revises the criteria for qualified petitioners who can initiate the establishment of a PID. It requires that petitions be signed by individuals who hold management positions in hotels and provides a written statement confirming their authority to act on behalf of hotel owners. The bill also modifies the petition requirements to ensure that signatories represent more than 60 percent of either the appraised value of hotel properties or the area of all properties liable for assessment under the proposal. Sections of the code that previously governed these matters are repealed, and the new provisions will apply to petitions filed on or after the effective date of the Act.
