House Bill No. 3755 amends Section 503.001 of the Business & Commerce Code to address the use of biometric identifiers in the context of artificial intelligence. The bill introduces a definition for "artificial intelligence," describing it as the use of machine learning and related technologies to enable computer systems to perform tasks typically associated with human intelligence, such as computer vision and natural language processing. Additionally, the definition of "biometric identifier" is modified to clarify that it includes various forms of biometric data, such as retina scans and fingerprints.
The bill also establishes that the provisions of this section do not apply to artificial intelligence activities unless they are specifically aimed at uniquely identifying an individual. If a biometric identifier is collected for the purpose of artificial intelligence but is later used for a different commercial purpose, the entity in possession of that biometric data must comply with the existing regulations regarding its possession and destruction, along with the associated penalties. This legislation is set to take effect on September 1, 2025.
