House Bill No. 3755 amends Section 503.001 of the Business & Commerce Code to address the use of biometric identifiers in the context of artificial intelligence. The bill introduces a definition of "artificial intelligence," which encompasses machine learning and related technologies that utilize data to train statistical models for tasks typically associated with human intelligence, such as computer vision and natural language processing. Additionally, the definition of "biometric identifier" is modified to clarify that it includes various forms of biometric data, such as retina scans and fingerprints.

The bill also establishes that the provisions regarding biometric identifiers do not apply to artificial intelligence activities unless they are specifically aimed at uniquely identifying an individual. If a biometric identifier collected for artificial intelligence purposes is subsequently used for a different commercial purpose, the entity in possession of that identifier must comply with the existing regulations concerning its possession and destruction, along with the associated penalties. This legislation is set to take effect on September 1, 2025.
