S.B. No. 1886 amends Article 18.067 of the Code of Criminal Procedure to allow for the execution of a search warrant for blood specimens from individuals suspected of intoxication offenses by any peace officer, rather than limiting it to specific law enforcement officers in adjacent counties. The previous requirement that the warrant could only be executed by law enforcement officers authorized to make arrests in the county of execution has been removed. This change aims to streamline the process of collecting blood specimens in intoxication cases.
The new law will apply only to search warrants issued on or after the effective date of September 1, 2025, meaning that any warrants issued prior to this date will still be governed by the existing laws. The bill received overwhelming support in both the Senate and House, passing with a vote of 31-0 in the Senate and 139-1 in the House.
