The bill, H.B. No. 3747, amends Section 540.0055 of the Government Code to allow Medicaid managed care organizations to engage in marketing activities related to certain private health benefit plans. Specifically, it introduces a new subsection (c) that establishes marketing guidelines, which cannot prohibit these organizations from informing individuals about the availability of qualified health plans offered through an exchange, as well as advertising Medicare Advantage plans or related benefits during community enrollment events.
Additionally, the bill includes a provision that allows state agencies to delay the implementation of any part of the Act if a waiver or authorization from a federal agency is required. The Act is set to take effect on September 1, 2025.
