S.B. No. 1874 introduces a new section to the Education Code that provides immunity for professional employees of school districts from certain disciplinary proceedings related to their actions concerning school discipline and law enforcement. Specifically, the bill defines "disciplinary proceeding" as actions taken by the school district to suspend or terminate an employee, or actions initiated by the State Board for Educator Certification. The bill stipulates that school employees cannot face disciplinary actions for reporting violations of Chapter 37 to other professionals, agencies, or law enforcement, or for taking good faith actions to remove a student from class under Section 37.002.

Additionally, the immunity granted by this bill is supplementary to any existing legal immunities and does not interfere with them. The provisions of this act apply to disciplinary proceedings for conduct occurring before, on, or after its effective date, although proceedings that were resolved prior to the act's enactment remain unaffected. The act is set to take effect immediately upon receiving a two-thirds majority vote from both houses of the legislature or on September 1, 2025, if such a vote is not achieved.
