S.B. No. 1864 amends the Agriculture Code to regulate the sale of ungraded eggs produced by individuals from their own flocks. The bill allows these producers to sell any quantity of ungraded eggs directly to consumers and up to 500 dozen per week at wholesale, provided they adhere to specific labeling and registration requirements. The new provisions include a requirement for labeling cartons with the word "ungraded," the producer's name and address, the packing date, and, if sold wholesale, the producer's registration number.

Additionally, the bill mandates that producers who sell ungraded eggs at wholesale must register with the relevant department, which may impose an annual registration fee not exceeding $50. The legislation also outlines sanitation and storage requirements, such as refrigerating the eggs within 36 hours of collection and maintaining them at a temperature of 45 degrees Fahrenheit or below. Furthermore, it prohibits state agencies or political subdivisions from restricting the purchase, resale, or use of these eggs by certain individuals. The act will take effect immediately upon receiving a two-thirds vote from both houses or on September 1, 2025, if that vote is not achieved.
