The bill, H.B. No. 3719, amends the Government Code by adding Section 552.0223, which addresses the availability of dates of birth under public information law. The new provision specifies that governmental bodies are not authorized to withhold a date of birth, except in certain circumstances. These exceptions include situations permitted by Section 552.102, compliance with federal privacy requirements under the Health Insurance Portability and Accountability Act of 1996, and any other provisions established by constitutional or statutory law.

The changes introduced by this bill will only apply to requests for information received by governmental bodies on or after the effective date of the Act. Requests made prior to this date will continue to be governed by the existing law. The Act is set to take effect immediately if it receives a two-thirds majority vote from both houses of the legislature; otherwise, it will take effect on September 1, 2025.
