H.B. No. 3560 amends the Health and Safety Code to update the licensing requirements for mental hospitals and mental health facilities, as well as to clarify the definition of "facility" for the employee misconduct registry. The bill reenacts and amends Section 253.001(4) to include new categories of licensed facilities, specifically adding (F-1) a facility licensed under Chapter 555; and (F-2) a facility licensed under Chapter 577;. This expansion aims to ensure that a broader range of mental health facilities is recognized under the law. Additionally, the bill modifies Section 577.004(d) to enhance the application requirements for mental hospitals and mental health facilities. It removes the phrase and from the list of required information and adds new requirements, including the name and address of the person responsible for the daily operations of the mental hospital or mental health facility; and (8) other information required by the department, including affirmative evidence of ability to comply with the department's rules and standards. The bill is set to take effect on September 1, 2025, contingent upon legislative appropriations for its implementation.
