S.B. No. 1759 introduces a new subchapter, Subchapter U, to Chapter 91 of the Natural Resources Code, which specifically addresses oil and gas emergencies. The bill defines an "oil or gas emergency" as any emergency related to oil and gas operations, including uncontrolled releases of oil, gas, or produced water. The executive director of the Railroad Commission of Texas is granted the authority to declare such emergencies in writing, detailing the nature of the emergency and the affected area. These declarations can last for up to 30 days but may be renewed for additional 30-day periods if the emergency persists. The commission also has the power to terminate the declaration once the emergency is resolved.

Additionally, the bill provides civil liability immunity for individuals who assist in responding to an oil or gas emergency, as long as their actions do not involve gross negligence, recklessness, or intentional misconduct. This immunity applies when assistance is provided at the request of an authorized representative of a state, local, or federal agency. The immunities outlined in this section are supplementary to any other legal protections already in place. The provisions of this subchapter will not apply to causes of action that arose before the bill's effective date of September 1, 2025.
