The bill amends various sections of the Health and Safety Code and Government Code to authorize certain counties in Texas to provide solid waste disposal services under specific conditions. It allows commissioners courts to contract for solid waste services in areas within the extraterritorial jurisdiction of municipalities, provided that the municipality does not offer such services. The bill specifies that this applies to counties with populations exceeding 1.5 million where at least 70% of the population resides in a single municipality, or to counties with populations under 1.3 million that contain a municipality with a population of 750,000 or more.

Additionally, the bill creates a criminal offense for individuals who intentionally or knowingly burn household refuse outdoors in designated unincorporated areas of counties that meet the specified population criteria. The legislation also clarifies that the changes will only apply to offenses committed after the bill's effective date, ensuring that any offenses occurring prior will be governed by the previous law. The bill is set to take effect immediately upon receiving a two-thirds vote from both houses or on September 1, 2025, if that threshold is not met.
