S.B. No. 1708, introduced by Hinojosa of Nueces and Lopez of Cameron, amends the Local Government Code to clarify exceptions to county platting requirements. The bill adds Section 232.0014, which states that the model subdivision rules adopted under Section 16.343 of the Water Code do not override existing exceptions to platting requirements or the applicability provision under Section 232.022(b-1). Additionally, it modifies Section 232.022 by specifying that the subchapter applies only to land subdivided into two or more lots primarily intended for residential use, with a presumption for lots five acres or less.

Furthermore, the bill introduces Subsection (b-1) to clarify that the subchapter does not apply to subdivisions that occur as a gift between relatives within the third degree of affinity or consanguinity, as defined in Chapter 573 of the Government Code. It also states that the subchapter will apply to any subsequent conveyance of lots that do not involve related persons as described. The bill is set to take effect immediately upon receiving a two-thirds vote from both houses or on September 1, 2025, if that vote is not achieved.
