The bill, S.B. No. 1696, amends various sections of the Health and Safety Code and the Transportation Code to mandate the inclusion of a person's biological sex on government documents, including birth and death certificates, as well as identification cards. Specifically, it introduces new subsections that require forms to include a space for recording biological sex as either male or female, based on the child's sex organs, chromosomes, or endogenous profile. It also stipulates that if a child's biological sex is not determined at birth due to atypical or ambiguous characteristics, this information does not need to be reported until it is established. Additionally, the bill outlines conditions under which birth certificates can be amended to reflect a person's biological sex.

Furthermore, the bill prohibits the issuance of death certificates that list a decedent's sex as the opposite of their biological sex as determined at birth. It also requires that applications for personal identification certificates and driver's licenses include a space for the applicant's biological sex. The changes apply only to documents issued or renewed after the effective date of the Act, which will take effect immediately upon receiving a two-thirds vote from both houses or on September 1, 2025, if not.
