The bill, S.B. No. 1692, introduces a limitation on the installed generation capacity of wind and solar energy facilities in the Electric Reliability Council of Texas (ERCOT) power region. It amends Section 39.1592(a) of the Utilities Code to apply specifically to electric generation facilities that sign a standard generator interconnection agreement on or after September 1, 2025, rather than the previously set date of January 1, 2027. Additionally, the bill adds Section 39.1596, which establishes criteria for electric generation facilities that rely exclusively on wind or solar energy.

Under the new provisions, the commission is required to assess by January 1, 2029, whether the installed generation capacity from these facilities exceeds 35 percent of the available generation capacity in ERCOT. If it does, the commission must create a program to disconnect certain facilities from the power grid, specifically those with agreements signed before the new effective date. The goal of this program is to ensure that the total capacity from wind and solar facilities remains at or below the 35 percent threshold. After the program's completion, new generation capacity may be allowed if it complies with existing regulations.
