S.B. No. 1681 introduces a new requirement for counties and municipalities in Texas that regulate boarding home facilities. Under the newly added Section 260.0105 of the Health and Safety Code, these entities must submit an annual written report to the commission by September 30 each year. The report must include details such as the current standards or ordinances for boarding home facilities, policies for reasonable accommodation requests, statistics on accommodation requests and complaints, information on support activities for facility operators, and a summary of complaints received against these facilities. Additionally, any updates to the standards or ordinances must be reported to the commission in the required format.
The bill also stipulates that counties and municipalities are not obligated to submit the first report until September 30, 2026, allowing for a grace period before the new reporting requirements take effect. The executive commissioner is granted the authority to adopt necessary rules for the implementation of this section. The act is set to take effect on September 1, 2025.
