House Bill No. 3459 proposes amendments to the distribution of state traffic fine revenue as received by the comptroller. The bill modifies Sections 542.4031(g) and (h) of the Transportation Code, changing the allocation of funds from 70% to 50% for both the general revenue fund and the designated trauma facility and emergency medical services account. Specifically, the comptroller will now deposit 50% of the revenue to the general revenue fund and 50% to the trauma facility account. Additionally, the bill stipulates that in any fiscal year where the total deposited to the general revenue fund reaches $250 million, any excess will be directed to the Texas mobility fund.

The amendments will only apply to revenue collected on or after the effective date of the Act, which is set for September 1, 2025. Revenue collected prior to this date will continue to be governed by the existing law. This change aims to ensure a more balanced distribution of traffic fine revenue, supporting both general state funding and emergency medical services.
