H.B. No. 3353 amends Section 97.002 of the Civil Practice and Remedies Code to limit the liability of certain transportation contractors, specifically those involved in the design, installation, construction, maintenance, or repair of highways, roads, and streets, as well as public safety or traffic management systems. The bill introduces a definition for "governmental unit" and specifies that contractors are not liable for personal injury, property damage, or death if they are in material compliance with contract documents at the time of the incident. The previous reference to the Texas Department of Transportation has been removed from the text.

The changes made by this Act will only apply to causes of action that accrue on or after its effective date of September 1, 2025. Any causes of action that arise before this date will continue to be governed by the law as it existed prior to the enactment of this bill.
