H.B. No. 3323 amends Section 127.003 of the Election Code to clarify the responsibilities and eligibility requirements for the tabulation supervisor at a central counting station. The bill stipulates that the tabulation supervisor must be trained in the operation of the automatic tabulating equipment and must either be a registered voter in the political subdivision or an employee of that subdivision. Additionally, it allows for employees of the political subdivision to be appointed as tabulation supervisors and receive additional compensation for their services.

The bill introduces new provisions that place the tabulation supervisor in charge of ensuring that the counting of ballots is conducted continuously until all ballots are counted. It also establishes that a tabulation supervisor can be penalized with a civil penalty of $500 for failing to comply with the requirements of this section, making them personally liable for any penalties assessed by the Attorney General. The tabulation supervisor is entitled to compensation determined by the authority that establishes the counting station. The act is set to take effect immediately upon receiving a two-thirds vote from both houses or on September 1, 2025, if that vote is not achieved.
