H.B. No. 3309 amends the Transportation Code to regulate the use of automated traffic control systems by local authorities and law enforcement agencies in Texas. The bill specifies that these entities may not implement or operate such systems for enforcing traffic laws, including posted speed limits, except in construction or maintenance work zones. In these designated areas, local authorities and law enforcement agencies are permitted to use automated traffic control systems to enforce compliance with traffic laws, provided they adopt policies for the prompt deletion of unrelated data and ensure that citations are issued by a peace officer at the time of the violation. Additionally, clear signage must be posted to inform drivers of the automated monitoring.
The bill also introduces new definitions and clarifications regarding automated traffic control systems, construction or maintenance work zones, and traffic laws. It establishes that the provisions of Chapter 707 of the Transportation Code do not apply to automated traffic control systems authorized under the new regulations. The act is set to take effect on September 1, 2025.
