The bill amends the Utilities Code to establish specific recycling and disposal responsibilities for grantees of wind and solar power facility agreements. It introduces a definition of "Recycle" as the processing of an item to recover a usable product and expands the definitions of "Wind power facility" and "Solar power facility" to include various components and support equipment. The bill mandates that agreements must include provisions requiring grantees to collect, reuse, or recycle components of the facilities, such as wind turbine blades and photovoltaic modules, and to dispose of non-recyclable components in compliance with state and federal laws.
Additionally, the bill requires that financial assurance be provided by the grantee to cover the costs associated with the removal, recycling, or disposal of facility components, as well as restoring the property to its original condition. The financial assurance must be based on estimates from an independent, licensed professional engineer and must be updated regularly. The provisions apply only to agreements entered into after the effective date of the Act, which is set for September 1, 2025.
