Senate Bill No. 1500 introduces a new section, 32.0465, to the Human Resources Code, which establishes written protocols for certain nonprescription drugs under Medicaid. The bill defines key terms such as "health care provider," "medical director," and "nonprescription drug," and allows the medical director to issue standing written protocols to enhance access to preventive care for recipients during pregnancy and the postpartum period. These protocols must include specific pharmacy instructions, identify eligible recipient populations, and list known contraindications. The protocols will expire one year after issuance.
Additionally, the bill provides civil liability protections for various parties involved in the issuance and implementation of these protocols. The medical director, health care providers, and pharmacy personnel are granted immunity from civil liability when they comply with the established requirements. The bill also stipulates that if a state agency requires federal authorization for implementation, it may delay the process until such authorization is obtained. The provisions of this Act will take effect on September 1, 2025, and will only apply to causes of action that accrue on or after that date.
