No. 3095 introduces a new subchapter to the Civil Practice and Remedies Code, specifically addressing liability for collisions involving motorists who have not established financial responsibility. The bill defines "financial responsibility" and "noneconomic damages," outlining that individuals who fail to establish financial responsibility in accordance with Chapter 601 of the Transportation Code cannot recover damages for bodily injury, death, or property damage resulting from a motor vehicle collision. Additionally, the personal representative of a deceased individual in such cases is also barred from recovering damages in wrongful death actions.

However, the bill provides exceptions to this prohibition. Individuals who have failed to establish financial responsibility for no more than 45 days, passengers in vehicles not owned or operated by them, minors under 18, and active-duty military members returning from deployment within the last six months are exempt from the limitations on recovery. Furthermore, damages caused by individuals driving under the influence, acting recklessly, or fleeing the scene of a collision are also excluded from these limitations. The bill is set to take effect on September 1, 2025, contingent upon receiving a three-fifths vote from both houses of the legislature.
