S.B. No. 1435 introduces a new provision in the Utilities Code that mandates the Texas commission to provide notice to specific officials when a transmission and distribution utility files an appeal related to a municipal order in a ratemaking proceeding. The new section, 33.0535, requires the commission to notify each member of the legislature whose district includes the municipality involved in the appeal, as well as the governing bodies of both the municipality and the county where the municipality is located.
The bill specifies that the changes will only apply to appeals filed on or after the effective date of the Act, which is set for September 1, 2025. Appeals filed before this date will continue to be governed by the existing law prior to the enactment of this bill.
