H.B. No. 3038 amends Section 5.552 of the Water Code regarding the notice of intent to obtain a permit from the Texas Commission on Environmental Quality. The bill requires that, within 30 days after the commission determines an application to be administratively complete, the applicant must place a sign at the site of the facility or proposed facility. This sign must include information such as the fact that a permit application has been filed, the applicant's contact information, the proposed site use, and how to contact the applicant for further information. Additionally, the applicant must comply with any applicable public notice requirements under relevant chapters of the code.
The bill also specifies the requirements for the sign, stating it must be at least 18 inches by 28 inches, consist of dark letters on a white background, and have lettering that is at least 1.5 inches in height and in block capital letters. The changes made by this Act will only apply to applications filed on or after its effective date of September 1, 2025, while applications filed before this date will be governed by the existing law.
