H.B. No. 3038 amends Section 5.552 of the Water Code regarding the notice of intent to obtain a permit from the Texas Commission on Environmental Quality (TCEQ). The bill requires that, within 30 days of the TCEQ determining an application to be administratively complete, the applicant must place a sign at the site of the proposed facility. This sign must include specific information such as the fact that a permit application has been filed, the applicant's contact information, the proposed site use, and how to contact the applicant for further information. Additionally, the applicant must comply with public notice requirements under relevant chapters of the code.
The bill also introduces new specifications for the sign, including minimum dimensions of 18 inches by 28 inches, the use of dark letters on a white background, and lettering that is at least 1.5 inches in height and in block capital letters. The changes will apply only to applications filed with the TCEQ on or after the effective date of the Act, which is set for September 1, 2025. Applications submitted before this date will continue to be governed by the existing law.
