The bill, H.B. No. 2961, amends Section 552.108 of the Government Code, which pertains to public access to information held by law enforcement agencies or prosecutors. The amendment redesignates the existing subsection (d) as (c-1) and clarifies that the exceptions to disclosure outlined in Subsections (a)(2) and (b)(2) do not apply to information if the individual depicted in the information is deceased or incapacitated, or if all living individuals depicted consent to the release of the information.

The changes made by this bill will only apply to requests for information received on or after the effective date of September 1, 2025. Requests received prior to this date will continue to be governed by the law in effect at that time. Additionally, the bill states that it will take precedence over any conflicting legislation from the 89th Legislature that pertains to nonsubstantive changes in enacted codes.
