S.B. No. 1349 introduces new criminal offenses related to transnational repression and the unauthorized enforcement of foreign law in Texas. The bill adds Sections 76.045 and 76.046 to the Penal Code, defining "transnational repression" and outlining the circumstances under which a person can be charged with these offenses. Specifically, it establishes that a person commits an offense if they act as an agent of a foreign government or terrorist organization to commit certain crimes with the intent to suppress protected conduct or retaliate against individuals for exercising their rights. The penalties for these offenses are set to be one category higher than the most serious offense committed, with a minimum term of confinement for first-degree felonies.
Additionally, the bill mandates the creation of a training program for peace officers regarding transnational repression, which will be developed by the Department of Public Safety. This program aims to equip officers with the skills to identify and respond to transnational repression, as well as to understand the tactics used by foreign governments and terrorist organizations. Furthermore, the Department of Public Safety is required to conduct a study on the threat of transnational repression and report its findings to the legislature by March 1, 2026. The act is set to take effect on September 1, 2025.
