H.B. No. 2907 introduces new regulations regarding the use of a tenant's name or likeness by landlords or their agents for commercial purposes. The bill adds Section 92.027 to the Property Code, which stipulates that any lease provision allowing such use must give tenants the option to opt out. Furthermore, any authorization for the use of a tenant's name or likeness is only valid during the lease term, and any agreements that violate this section are deemed void.

Additionally, if a landlord or their agent improperly obtains a tenant's consent or uses their name or likeness in violation of this new section, the tenant is entitled to recover damages, including one month's rent, injunctive relief, and reasonable attorney's fees. The provisions of this bill will apply to leases or agreements entered into or renewed on or after its effective date of September 1, 2025.
